1.2 By accessing this website or placing an order, you agree to be bound by these Terms. If you do not agree, you must not use this website.

2. Definitions

2.2 “Customer”, “you”, or “your” refers to the person using the website or purchasing products.
2.3 “Products” means the goods available for purchase on the website.
2.4 “Supplier” means third-party manufacturers or distributors from whom we source Products.

PART B: TERMS & CONDITIONS FOR SALE OF GOODS
3. Eligibility & Use of Website
3.1 You must be at least 18 years of age to place an order. If you are under 18, you may only place an order with the involvement and consent of a parent or legal guardian, who will be deemed the contracting party.
3.2 You agree not to use this website for unlawful purposes, or in any way that may damage or impair its operation.
3.3 We may suspend, restrict, or terminate your access to the Website at any time, without notice, if we suspect misuse, fraudulent activity, security concerns, or for any other reason at our discretion.
4. Formation of Contract
4.1 When you place an order through the Website, or via an order created on your behalf by our staff, you are making an offer to purchase the Products listed.
4.2 We will review your order, confirm payment has been received and cleared, and check stock availability with our suppliers. A binding contract is formed only when we email you a Sales Order Confirmation (which may include a PDF attachment or other written confirmation). Until that time, your order remains an offer that we may accept or reject at our discretion.
4.3 You must check your order carefully before submission. Once submitted, cancellations or changes may only be made by agreement, unless otherwise required by law.
4.4 We reserve the right to refuse or cancel orders at our sole discretion, including for errors in pricing or product description, unavailability of stock, withdrawal or suspension of a product, or where delivery is not available to your location, and without liability.
4.5 If we reject an order after payment has been received, you are entitled to a refund (or credit, where agreed with you) for any amount paid.
4.6 You must provide a valid email address and mobile phone number so we can communicate with you about your order. Email is our primary form of communication, and you are responsible for ensuring that emails from @waterpumpsdirect.com.au are received (including checking spam/junk folders and whitelisting our domain). We may also contact you by SMS or other electronic messaging services.
4.7 If you place an order for delivery to another person, you confirm that you have their consent to provide their personal details to us for fulfilment purposes.
5. Pricing & Payment
5.1 All prices communicated by us — whether on the website, in quotes, invoices, order confirmations, or other correspondence — are stated in Australian dollars (AUD) and include GST unless otherwise stated.
5.2 We may change prices at any time prior to accepting your order.
5.3 Payment must be made at the time of order via approved methods including debit/credit cards or other options offered at checkout.
5.4 Payments are processed securely by third-party providers (such as Stripe). We do not store or retain your full card details (debit or credit) on our servers. Limited card information (such as the last four digits and expiry date) may be visible to us via Stripe for transaction and customer service purposes. You agree to also be bound by the terms and privacy policies of such providers.
5.5 Unless specifically stated otherwise, transaction costs may apply to certain payment methods, including debit/credit cards and other transactions processed via Stripe. We reserve the right to charge a surcharge to cover the costs of processing your payment, whether or not such charges are itemised on your order or invoice. Transaction costs may change from time to time, but will not exceed our own direct costs of processing.
5.6 By placing an order, you confirm that you are authorised to use the payment method provided and that you have not engaged in any fraudulent or unlawful conduct.
5.7 Invoices are issued electronically by email after payment has been processed and the order has been secured with suppliers. A Tax Invoice is normally issued once the goods have been picked up for delivery or confirmed as dispatched by our supplier(s). You are responsible for ensuring that you have access to the email account provided at the time of order, as this is the primary method we use to communicate with you about your purchase.
6. Delivery & Risk
6.1 Unless otherwise stated, products are shipped from our suppliers or directly from us.
6.2 Any delivery timeframes communicated by us — whether on the website, in order confirmations, invoices, emails, quotes, or other correspondence — are estimates only. Actual delivery times may vary depending on supplier availability, shipping conditions, and courier services.
6.3 All delivery times provided by us are based on our best subjective analysis of prior orders and typical courier performance. They may represent “best case” scenarios and cannot account for every special circumstance. We do not guarantee delivery within any stated timeframe and are not liable for any loss, damage, cost, expense, or injury you or any third party incur as a result of delivery delays, whether caused by suppliers, couriers, our staff, or otherwise.
6.4 We reserve the right to adjust delivery charges if the delivery address or delivery options you provide are incorrect or incomplete. We may also adjust delivery fees if courier or supplier charges change after your order is placed. If an adjustment is required, we will notify you and you will be given the option to re-confirm your order with the revised charges or to cancel for a full refund.
6.5 Where an order is shipped to more than one delivery address (whether at your request or as arranged with us), delivery fees will apply for each delivery destination. Additional charges may also apply where you request changes to the delivery address after the order is placed.
6.6 From time to time, a supplier may advise that a product is unavailable after you place an order. In such cases, we will notify you and offer the option to: (a) cancel the order for a full refund, (b) accept a suggested alternative product (with any difference in price refunded or payable), or (c) wait for the original product to become available where an estimated restock date is provided.
6.7 Where you place multiple orders, we may at our discretion consolidate them into a single delivery or ship them separately. Delivery fees will apply as per each order unless otherwise agreed in writing.
6.8 Title in the products remains with us until full payment has been received and cleared. Risk in the products passes to you upon delivery to the address you provide. We will rely on confirmation provided by the courier or delivery agent (including tracking updates, delivery scans, and photographic evidence, where available) as evidence of delivery, unless reasonable evidence to the contrary is provided and accepted by us in our reasonable discretion. It is your responsibility to ensure that delivered goods are collected and secured promptly once delivered.
6.9 You must inspect your products within seven (7) days of delivery and notify us promptly if any goods are defective, damaged, missing, or incorrect. We strongly recommend opening packages to confirm the correct pump model or product has been supplied. Notifying us within this timeframe helps ensure an appropriate and timely remedy can be provided.
6.10 You are responsible for ensuring correct delivery details are provided and for accepting delivery. If the courier or delivery agent determines that delivery to the nominated address is unsafe, insecure, or impractical, your goods may be taken to a local depot, postal outlet, or collection point. It is your responsibility to collect the goods within the required timeframe. Additional charges may apply for re-delivery or redirection.
7. Returns, Refunds & Consumer Guarantees
7.1 Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for other reasonably foreseeable loss or damage.
7.2 You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
7.3 To request a return or refund, you must contact us via the details below. We will provide instructions, which may require return of the goods to the supplier.
7.4 We do not accept returns for change-of-mind purchases.
7.5 Where refunds are issued, any non-refundable Transaction Fee (as defined in clause 2.6) will not be refunded, except where required by law.
7.6 Refunds agreed to will be processed promptly, but the time taken to appear in your account depends on your financial institution.
7.7 We are not responsible for delays once the refund has been issued, nor are we responsible if a refund fails because you provided inaccurate or incomplete bank or payment details.
7.8 When possible, refunds will be made to the original payment method used for the order, in accordance with card scheme rules.
8. Warranties & Disclaimers
8.1 Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Except as required under the ACL or expressly stated otherwise, we make no warranties or representations regarding the products, their fitness for purpose, or accuracy of descriptions.
8.2 Some products may also come with a manufacturer’s warranty. These warranties are provided directly by the manufacturer and are separate from your rights under the ACL. While we may provide reasonable assistance to help you make a claim, it is usually faster and more effective for you to deal directly with the manufacturer for warranty matters.
8.3 To the maximum extent permitted by law, we disclaim all other warranties, whether express or implied.
8.4 Images of products on the Website, in our emails or attachments, or in any brochures or documents we share are for illustrative purposes only. Sizes, dimensions, and colours may differ slightly in real life, and accessories shown with products are for demonstration purposes only.

10. Promotions & Discounts
10.1 Offers and promotions may only be used on the Website, including for purchases of Products selected from the Website and purchased through the shopping cart. You may receive online offers and promotions which include a Code for use when shopping at the Website. It is your responsibility to ensure that the Code is valid, and that you enter the Code at the time of making your purchase online. We cannot apply a Code retrospectively once you have submitted your Order.

10.3 Any Code is non-transferable and, unless expressly stated, may not be used in conjunction with any other offers. If your Code is lost or stolen it will not be reissued.
10.4 Any “% off” discount stated applies to the Australian recommended retail price (RRP) of items, including the Australian GST component of that price. Discounts, including any “% off”, are not available when purchasing gift cards.
10.5 We may withdraw, cancel, or change any promotion or Code at our discretion without notice.

11. Ownership of Submissions
11.1 Other than personal information (which is subject to our Privacy Policy), you retain ownership of any Submissions you provide.
11.2 By making a Submission, you grant us a worldwide, royalty-free, perpetual, transferable licence to use, copy, modify, publish, and distribute your Submissions in any media, including for promotional purposes. This includes the right to share, publish, or distribute Submissions through third parties, partners, associates, and online platforms. This licence also includes our right to refuse, remove, or delete Submissions at our discretion.
11.3 You warrant that you own or have the necessary rights to make the Submission and that it does not infringe the rights of others.
